Chairman Gallup opened the meeting at 6:30PM

REVIEW OF ITEMS FOR SIGNATURE:
Motion to approve the following CZC’S: Parcel ID: 0138-0037-000, 15A Stagecoach Rd. Myrtle, Dennis & Lynne Wiggins. Parcel ID: 0215-0006-0000, 325 North Rd. Deborah & Robert Dellinger. Parcel ID: 0112-0019-0000, 24 Woodland Rd. Kimberly & Lowell Putnam by Selectman Gottling, seconded by Selectman Brown. Unanimous.

Ludwig Gift Public Hearing opened at 7:00PM
Chairman Gallup stated that this is the first of (2) public hearings pursuant to RSA 41:4-a Acquisition or sale of land, to accept the gift of the 2.23 acre parcel owned from the Ludwig Family. The property is located on the westerly side of Jobs Creek Road, and abuts the land of the Sunapee Town Forest known as “Dewey Woods”. The next public hearing will be February 13th at 7:00PM.

Chief David Cahill
Chief Cahill asked the Board to authorize the expenditure of $5,000 from the Police Detail Revolving account to update and replace the portable radios with new ones. Motion to authorize the expenditure of $5,000 from the Police Detail Revolving account to update and replace portable radios by Selectman Brown, seconded by Selectman Gottling. All in Favor.

Scott Blewitt
Motion to accept donations and add to the Recreation budget, the $500 donation from the Sunapee Seniors and the $500 donation from Morgan and Loretta Dewey and permission to expend as requested by Selectman Brown, seconded by Selectman Gottling. Unanimous.

•Motion to sign the MS-6, by Selectman Brown, seconded by Selectman Gottling. Unanimous.
•Motion to sign the Default Budget by Selectman Brown, seconded by Selectman Gottling. Unanimous.
•Motion to sign the Town Warrant by Selectman Gottling, seconded by Selectman Brown. Unanimous.
•Motion to accept the bridge abutment gift by Selectman Gottling, seconded by Selectman Brown. Unanimous.    
•Motion to allow Chairman Gallup to sign the use of facilities application submitted by Michael Medeiros & Lindsey Keaney to use the Gazebo for a wedding on June 9th by Selectman Brown, seconded by Selectman Gottling. Unanimous
•Motion to allow Chairman Gallup to sign the use of facilities application submitted by Kelli McHugh & Jason Barton to use the Gazebo for a wedding on September 8th by Selectman Gottling, seconded by Selectman Brown. Unanimous
•Motion to appoint Barbara Sullivan as a full member to the Harbor House Livery Committee by Selectman Brown, seconded by Selectman Gottling. Unanimous
•Motion to appoint Donna Gazelle as a full member to the Harbor House Livery Committee by Selectman Gottling, seconded by Selectman Brown. Unanimous
•Motion to appoint Eileen Stiles as an alternate member to the Harbor House Livery Committee by Selectman Brown, seconded by Selectman Gottling. Unanimous

Chairman’s Report
•Chairman Gallup stated that there are a number of “house bills” that are scheduled for hearings according to the Legislative Bulletin #6 received from the NH Municipal Association on Friday, January 27th. Donna Nashawaty stated that Betty Ramspott asked the Board to “voice” their opposition to the Town’s Legislative Representative regarding HB 1674, which reduces the interest rate on delinquent taxes from 12 percent to 6 percent per lien and from 18 percent to 9 percent post lien.

Motion to instruct the Town Manager to email the members of the Municipal and County Government Committee, and urge them to oppose HB 1674 by Chairman Gallup, seconded by Selectman Gottling. Unanimous.
•Selectman Brown would like an email to be sent to the Municipal and County Government Committee that states the Board opposes HB 1176, which states no petition warrant article shall be amended. Selectman Brown feels the discussion and possible amendments to positively affect a petitioned warrant article is necessary to the voter.  Especially if there is a defect in the article and an unintended consequence comes out of it.~ The body at the deliberative session is in control in the majority on all other warrant articles why should they not be on a petitioned article. Motion to instruct the Town Manager to email the members of the Municipal and County Government Committee, and urge them to oppose HB 1176 by Chairman Gallup, seconded by Selectman Brown. Unanimous.
•Selectman Brown would also like an email to be sent to the Municipal and County Government Committee that states the Board opposes HB1292,  which changes to require 2/3 majority instead of the 3/5 or 60% currently allowed should be opposed.~ The 60% is adequate and almost impossible to meet now, 2/3 would be almost impossible.~Motion to instruct the Town Manager to email the members of the Municipal and County Government Committee, and urge them to oppose HB 1292 by Chairman Gottling, seconded by Chairman Gallup. Unanimous.
•Selectman Brown would like an email to be sent to the House Judiciary Committee that states the Board opposes HB 1506, which would remove the exemption under the Right to know Law for records pertaining to personnel files.~ The Board of selectmen opposes HB 1506 and wants the committee to know of the problems that would arise if records are made public.~ Performance reviews are the most important tool when dealing with employee’s especially to help make a better employee by taking corrective action.~ If the supervisor or the employee knew that the information was to be subject to public review they would be more unlikely to participate this way.~ In addition there are some other information that is confidential, checking account numbers, beneficiaries to life insurance, alimony payments etc.~ We strive to hire and keep good employees that in turn take care of the property of the town, keeping down the tax rate.~ The legal ramifications if negative information made its way into the public would be disastrous.~ ~
Motion to instruct the Town Manager to email the members of the House Judiciary Committee, and urge them to oppose HB 1506 by Selectman Brown, seconded by Selectman Gottling. Unanimous.
•Donna Nashawaty read the memo that was received by the Town Attorney regarding the December 8th, 2011 NH Supreme Court decision regarding the Right to Know Law. Peter Urbach asked if the memo would be circulated to other Boards and Committees, the Board agreed that it should be circulated.

Town Manager Report
•Donna Nashawaty reviewed the memo received from Norm Bernaiche, Assessor regarding solar energy exemptions.
•Donna Nashawaty informed the Board that she is working on a couple of policies that the Auditors suggested should be in writing.
